These Terms of Service ("Terms") govern your use of builderhotsheets.com (the "Site"). By using the Site or submitting a request through it, you agree to these Terms. If you don't agree, please don't use the Site.
The Site is an advertising and marketing site operated by
John Robertson, a Texas real estate licensee (TREC
#706106)
The Site is not a real estate brokerage and does not hold a brokerage license. All real estate brokerage services referenced on the Site are provided through Ignite Realty. Nothing on the Site creates an agency or representation relationship on its own — see Representation below.
We publish a directory of new-construction home deals and builder incentives in Texas, gathered from builders and their sales agents. We are not the seller of any home shown, we do not set prices or incentives, and we are not a party to any contract between you and a builder. Listings are provided for information only and are not an offer.
Submitting an inquiry, a valuation request, or an agent registration request through the Site does not make John Robertson your agent and does not create a fiduciary or representation relationship. Buyer or seller representation begins only when a written representation agreement is signed by both you and Ignite Realty.
If you are already represented by another real estate agent under a written agreement, this is not an attempt to solicit that business — please disregard.
Many builders will only compensate a buyer's agent if that agent is registered on the buyer's first visit to the community. We describe this because it materially affects buyers, but the rule belongs to each builder, can change without notice, and we cannot guarantee any builder's decision in any particular case.
Ignite Realty is not the listing broker for the homes shown on this Site and does not hold an exclusive right to sell agreement with any builder, community, or property featured here. We do not represent the builders and we are not their agent. Homes, prices, incentives, and availability are offered by the builder or its listing broker, are supplied to us by them, and are subject to change or withdrawal without notice. Nothing on the Site is an offer to sell or a solicitation of an offer to buy.
Where a property shown is subject to an exclusive listing agreement held by another broker, it is advertised with that broker's permission and that broker is identified. If you believe a listing appears here without authorization, contact us and we will remove it.
Figures produced by the rebate calculator are estimates only and are not an offer, quotation, or guarantee. A rebate is a share of the commission the builder actually pays Ignite Realty. If a builder pays a reduced commission, the rebate is reduced proportionally; if a builder pays no commission, no rebate is available.
Any rebate is offered with the authorization of Ignite Realty and is subject to the consent of the seller, to the approval of your lender, and to all applicable federal, state, and local laws and regulations, including the Real Estate Settlement Procedures Act and the rules of the Texas Real Estate Commission.
A rebate is contingent on a signed written representation agreement, is applied as a credit at closing, and must be disclosed on the Closing Disclosure. Your lender may limit, restrict, or prohibit how a credit is applied, and some loan programs do not permit one at all. Rebates may not be available on every transaction. Figures shown assume a typical builder commission and are not specific to any particular home until confirmed in writing.
Program. Builder Hot Sheets deal alerts. If you opt in, we send text messages about new-construction homes, price reductions, and builder incentives matching the criteria you chose.
How you opt in. By entering your mobile number and checking the consent box on our alert signup page. The box is never pre-checked. Consent is not a condition of any purchase or of any service we provide — you can use every part of this site, and work with us, without agreeing to receive texts.
Message frequency. Varies according to the alert settings you choose and how many homes match them. Instant alerts send as matches appear; digests send daily or weekly.
Cost. Message and data rates may apply. We do not charge for the alerts themselves.
Opting out. Reply STOP to any message to stop all further texts. Reply HELP for help, or use the management link in any alert we send you.
Support. Email support@builderhotsheets.com for help with the messaging program.
Your number stays with us. Mobile phone numbers and SMS opt-in information are never shared with or sold to third parties or affiliates for their marketing or promotional purposes. See our Privacy Policy.
Delivery. Carriers are not liable for delayed or undelivered messages. Not all mobile devices or carriers are supported.
Deal information reaches us from builders and their sales agents, and every item is reviewed before publication. Even so, we do not independently verify pricing, incentives, availability, or expiry dates with the builder, and these change frequently and without notice. Always confirm current terms with the builder before relying on them. We may edit, reject, or remove any listing at any time without notice.
We support the Fair Housing Act and the Equal Opportunity Act. All homes advertised on the Site are available without regard to race, color, religion, sex, handicap, familial status, or national origin.
The Site and its listings are provided "as is," without warranty of any kind. We don't guarantee that any deal, price, or incentive shown is currently available, or that the Site will be uninterrupted or error-free.
To the fullest extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the Site, or from any transaction, dispute, or communication between you and a builder or their sales agent. Nothing in these Terms limits any obligation that cannot be limited under the Texas Real Estate License Act or the rules of the Texas Real Estate Commission.
We may update these Terms from time to time; continued use of the Site after a change means you accept the updated Terms.
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
